37mm and M79 Legalities

Covered extensively on this site, 37mm launchers are exempt from the National Firearms Act of 1934 and do not need to be registered with the ATF.  This remains the case as long as it is not being used as a “destructive device”.  Rounds considered to be “destructive” would be wood pellets, bean bag rounds, or other anti-personnel rounds.  If a user would like to use a launcher in this capacity, the launcher would need to be registered with the ATF and a serial number (ATF provided) engraved on the side (this is not a difficult process)

37mm, as a signaling device, was originally used for military purposes back in World War 2.  37mm in a weapon capacity, was used as far back as World War 1.  Our focus will be on its signaling capabilities.

At the moment, each 37mm can NOT contain more than 109 grains of gunpowder. Exceeding this amount requires licensing and is generally reserved for less-lethal or anti-personnel rounds and will likely mean that the round will be considered a “destructive device”.  Meaning, the lift charge and the secondary charge (the payload) can not be over 109 grains of gunpowder total.

40mm – In the United States, 40 mm barrels are classified as “destructive devices” under the National Firearms Act (NFA) because they are a “non-sporting” firearm with a bore greater than one-half inch in diameter.  Meaning, 40mm is considered “anti-personnel” and owning one means you must follow the guidelines set forth by the ATF.

Governing Documents and Regulations on 37mm and 26.5mm

These documents define and regulate what constitutes a firearm and outline the associated rules and restrictions. The definition of a destructive device includes:  “… any type of weapon… which has any barrel with a bore of more than one-half inch in diameter…”.

Launchers with 37mm and 26.5mm bore sizes clearly exceed 0.5″. However, within the same regulations, there is an exemption: “… the term destructive device shall not include any device which is neither designed nor redesigned for use as a weapon any device, although originally designed for use as a weapon, which is redesigned for use as a signalling, pyrotechnic, line throwing, safety, or similar device…

This exemption applies to 37mm and 26.5mm launchers. The key phrase is: “… neither designed nor redesigned for use as a weapon…”.  This means manufacturers of launchers must create them with the intent to comply with this exemption – which ExoticAmmo / OrdnanceGroup obviously does! Our launchers are designed as signaling devices, and their intended use aligns with this classification.

The ATF has ruled that: “When a gas slash flare gun is possessed with ‘anti-personnel’ type ammunition registration as a ‘destructive device’ is required.

This means owning both a launcher and ammunition classified as anti-personnel changes the launcher’s classification. Even if your intent is lawful, the ATF may assume otherwise.

The ATF defines anti-personnel ammunition as: “… consisting of cartridges containing wood pellets, rubber pellets, or balls, or bean bags…

Without proper licensing, it is crucial to avoid such projectiles to maintain compliance. Furthermore, intent alone can alter the classification of a launcher. If someone intends to use a launcher against another person, they may demonstrate intent to harm, reclassifying the launcher as a weapon and destructive device—regardless of the ammunition type.

37mm Rounds – Hulls Make a Difference – Plastic vs Aluminum

Aluminum hulls come in both 3″ and 5″ version.  For most applications, 3″ should be completely adequate. There are some specific cases in which a 5″ hull maybe desired (for example when a longer payload is used – smoke).

Performance, Our Observations – 37mm Rounds (37mm Ammo)

After putting these launchers through the wringer, the clear takeaway: longer barrels give you a bit more oomph. A 12” (or 14”) tube will generally spit rounds with marginally better launch performance than a 6” — the difference isn’t dramatic, but it’s real and noticeable on the range.

That said, there’s always a tradeoff: weight and balance. The 6” Pivot and 6” Tac-79P are noticeably lighter and much friendlier when mounted under an AR. Sling a 12” underbarrel on an already-loaded rifle and you’ll start to feel that front-heavy tug (think M203 vibes).
